Privacy Policy for Creator

This Privacy Policy applies to creators on the Designmycraft.


1. The types of personal information we collect and use

We collect and use the following information about you:

Your user account information. You give us information when you register on the Platform, including your username, password, email address, contact number and the name of the organisation you are representing.

Your activity on the Platform. When you use the Platform, we collect your activity and browsing history such as which creators you have previously viewed or activity in relation to creators that you manage.

Technical information we collect about you. When you use the Platform, we automatically collect information generated from your browser or device, including your IP address, settings and device ID.

Payment information: We collect payment information to facilitate payments and refunds. Such information may include your card information such as the name on your card, card type, card number, billing address, and expiration date, as well your bank account information such as beneficiary name, account number or IBAN, SWIFT BIC, beneficiary address.

2. How we use your personal information and the legal basis for this

In order to perform our contract with you, we will use your information to authenticate you and grant you access to the Platform, provide you with user support, facilitate payments and refunds, enforce our terms, conditions and policies and to administer the Platform, including troubleshooting. Where you wish to partner with one of our creators, we will send a message to the creator, inviting them to contact or authorize you directly and providing them with your email address and phone number.

3. How we share your personal information

We share your personal information with:

i) creators, talent managers, and brand personnel (and their agents) you wish to contact;

ii) service providers who support our business, such as cloud service providers and payment service providers;

iii) other members, subsidiaries, or affiliates of our corporate group, to provide the Platform including improving and optimising the Platform, preventing illegal use and supporting users; and

iv) law enforcement agencies, public authorities or other organisations if legally required to do so.

We will also disclose your information to third parties in the event that we sell or buy any business or assets (whether a result of liquidation, bankruptcy or otherwise) or if we sell, buy, merge, are acquired by, or partner with other companies or businesses.

If required by the applicable laws or requested by authorities to the extent permitted by laws, we will also disclose your personal information to the relevant law enforcement agencies, public authorities or other organizations.

4. Where we store your personal information

If you are using our Platform from the European Region, your personal information will be processed outside of the European Region. Where we transfer your personal information to countries outside the European Region, we ensure that the personal information is transferred to countries recognised as offering an equivalent level of protection or the transfer is made pursuant to standard data protection clauses adopted by the European Commission. 

For other jurisdictions besides European Region, your personal information will also be processed outside your jurisdictions. Where we transfer your personal information to countries outside your own, we have taken steps to ensure an adequate level of protection of your information irrespective of where it is located. Without prejudice to this, we will also ensure that the transfer and/or transmission of your personal information is carried out in accordance with this policy and the requirements of the applicable laws. Please be informed that if the countries to which we may transfer your personal information and/or in which our servers are located may be countries that are not considered as having adequate level of protection by your applicable laws, you explicitly consent and authorize us to transfer your personal information by accepting this policy.

5. Rights for Users in the European Region

If you are using the Platform from the European Region, in accordance with applicable privacy law, you have the following rights in respect of your personal information that we hold:

i) access a copy of your personal information;

ii) request rectification or removal of your personal information;

iii) request that we restrict certain processing operations;

iv) the right to data portability where we process your personal information because it is necessary for the performance of a contract and processing is carried out by automated means;

v) where processing your personal information is based on consent, the right to withdraw that consent;

vi) the right not to be subject to automated decisions, including profiling;

vii) the right to object to processing in certain circumstances; and

viii) the right to lodge complaints before the appropriate data protection regulator.

Before we can respond to a request to exercise one or more of the rights listed above, you may be required to verify your identity or your account details.

6. Rights for Users who are California Residents

This section contains additional disclosures required by the California Consumer Privacy Act of 2018 (“CCPA”) and applies only to “personal information” that is subject to the CCPA and only to California residents. Currently, personal information we collect about you where you are acting on behalf of a brand or talent agency on the platform is exempt from most CCPA obligations. We do not and have not in the last twelve (12) months sold personal information about you.

7. Rights for Users in the Rest of the World

If you are using the Platform outside European Region and the US, in accordance with applicable privacy law, you have the following rights in respect of your personal information that we hold:

i) access a copy of your personal information;

ii) request rectification or removal of your personal information;

iii) the right to object to processing in certain circumstances;

iv) the right to data portability where we process your personal information because it is necessary for the performance of a contract and processing is carried out by automated means;

v) the right not to be subject to automated decisions, including profiling;

vi) where processing your personal information is based on consent, the right to withdraw that consent; and

Indonesia Confidentiality. You can request to treat your personal information as confidential and process accordingly.

8. How long we keep your personal information

We retain your information for as long as it is necessary to provide you with the service so that we can fulfil our contractual obligations and rights in relation to the information involved. Where we do not need your information in order to provide the service to you, we retain it only for so long as we have a legitimate business purpose in keeping such data. However, there are occasions where we are likely to keep this data for longer in accordance with our legal obligations or where it is necessary for the establishment, exercise or defence of legal claims.

After you have terminated your participation in the Platform, we store your information in an aggregated and anonymised format.

9. The security of your personal information

We take steps to ensure that your information is treated securely and in accordance with this policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, for example, by encryption, we cannot guarantee the security of your information transmitted via the Platform, which means any transmission is at your own risk.

We have appropriate technical and organisational measures to ensure a level of security appropriate to the risk that may be posed to you and other users. We maintain these technical and organisational measures and will amend them from time to time to improve the overall security of our systems.

We will, from time to time, include links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any information to these websites.

10. Changes

We will notify you of any material changes to this policy through a notice provided via the Platform or by other means. The “Last Updated” date at the top of this policy reflects the effective date of such policy changes.
